1. Introduction

These Terms of Service (“Agreement”) govern the use of services provided by the Tamaskan Dog Association (“we”, “our”, “us”). By accessing and using our website https://tamaskandogassociation.com, and by purchasing or using our services, you (“Client”, “you”) agree to comply with these Terms and any additional policies referenced herein.

The Tamaskan Dog Association operates as a trade name of Wolfsbane Creations, registered in the Netherlands under Chamber of Commerce (KvK) number 62669354.

2. About the Tamaskan Dog Association

The TDA was founded in 2024 to provide a centralized, cohesive experience for Tamaskan Dog owners, breeders, and enthusiasts. Our mission is to promote ethical breeding, serve as an international resource for the breed, and unify the community.

3. Membership Tiers and Services

We offer three distinct membership tiers. Access to specific features depends on the tier you select.

3.1 Free Membership

  • Cost: €0
  • Benefits:
    • Access to member-only articles
    • Ability to enter your Tamaskan in our Virtual Show.

3.2 Basic Membership

  • Cost: from €4.50 (see section 4)
  • Benefits: Includes all Free Membership benefits, plus:
    • Entry of your dog(s) in our Title Programs.
    • Participation in Virtual Challenges with your dog(s).

3.3 Pro Membership

  • Cost: from €7.50 (see section 4)
  • Benefits: Includes all Free and Basic Membership benefits, plus:
    • Full access to the Breed Database.
    • Full access to the Matchmaker Tool.

4. Fees and Payment Terms

4.1 Pricing Structure

Membership fees are charged upfront for a fixed period. There are no hidden fees.

  • Basic:
    • 3 months: €4.50
    • 6 months: €9.00
    • 12 months: €18.00
  • Pro:
    • 3 months: €7.50
    • 6 months: €15.00
    • 12 months: €30.00

4.2 Non-Auto-Renewal Policy

All memberships are non-recurring and do not auto-renew. When you purchase a membership, you pay a one-time fee for your selected duration of 3, 6, or 12 months. At the end of this period, your access to premium features will expire unless you manually log in and purchase a new membership term.

4.3 Payment Processing

Payments are processed securely via Stripe. By purchasing a membership, you authorize Wolfsbane Creations to charge your selected payment method for the applicable fee. All prices are quoted in Euros (€), and as Wolfsbane Creations is registered under the Dutch small businesses scheme (KOR), no VAT is charged on these prices.

4.4 Refund Policy

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason. We voluntarily extend this policy and will provide a full refund upon request within 14 days of purchase, regardless of whether the service has been used. In addition, refunds may be issued outside of this 14-day period in cases of technical errors or service failures attributable to us.

4.5 Disputes and Chargebacks

If you have any concerns regarding a payment or service, we encourage you to contact us first so we can resolve the issue quickly, before initiating a chargeback or payment dispute.

5. User Accounts and Eligibility

5.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password.
  • Notify us immediately of any unauthorized use of your account.

5.2 Age Restriction

You must be at least 16 years old to use this Site. Users under 18 must have permission from a parent or legal guardian.

5.3 Termination of Account

We reserve the right to suspend or terminate your account and access to the Site if you violate these Terms or engage in conduct that is harmful to the TDA community or other members. Where reasonable, we will provide notice before termination.

6. Code of Conduct and Community Guidelines

As a community focused on ethical breeding and responsible ownership, we maintain strict standards for behavior. All members must adhere to our Code of Conduct, which is incorporated into these Terms by reference.

By using the Site, you agree to abide by the rules set forth in the Code of Conduct. Failure to comply with the Code of Conduct constitutes a material breach of these Terms. We reserve the right to remove content, suspend accounts, or ban users who violate these guidelines.

6.1 Content Ownership

You retain ownership of the content you submit (e.g., photos of your dog, articles). However, by submitting content, you grant the TDA a non-exclusive, royalty-free license to display, distribute, and modify such content for the purpose of operating the Site and promoting the Tamaskan breed.

7. Intellectual Property

The Site, including its original content, features, functionality, logos, and the “Tamaskan Dog Association” name, is owned by Wolfsbane Creations and is protected by international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our express written permission.

8. Disclaimers and Limitation of Liability

8.1 Informational Use Only

All information and tools on the Site (including the breed database and matchmaker tool) are provided for informational purposes only. They do not constitute veterinary, legal, or professional breeding advice.

8.2 “As Is” Basis

The Site is provided on an “as is” and “as available” basis. We make no warranties, expressed or implied, regarding the accuracy of the Breed Database or the success of the Matchmaker Tool.

8.3 Limitation of Liability

To the fullest extent permitted by Dutch law, Wolfsbane Creations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of the Site.

9. Privacy and Data Protection

We are committed to protecting your privacy. Our collection and use of personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the General Data Protection Regulation (GDPR) and do not sell your personal data to third parties. Payment data is handled securely by Stripe and is not stored on our servers.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of the Site shall be subject to the jurisdiction of the competent courts in the Netherlands.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.
